Ralph R. Maiolino Attorney

Attorney Ralph R. Maiolino III was born and raised in York, Pennsylvania. He received his B.A. in History from York College of Pennsylvania in 2018, where his senior thesis was featured by the College and published in its leading academic journal “Past & Present”. He subsequently received his Juris Doctorate from Rutgers Law School in Camden, NJ in 2021, where he participated in Moot Court & served as an elected member of the SBA. He relocated to Florida immediately upon his graduation from law school and his successful passage of the Florida Bar Exam.

Since becoming an Attorney, Ralph has dedicated his career to fighting for the People against the interests of the powerful. He first worked as an Assistant State Attorney in Bartow, FL, where he tried multiple cases to jury verdict, winning 2/3 of them, and managed a full-time criminal caseload. He then moved to Orlando, FL where he continued to serve as an Assistant State Attorney in the 9th Judicial Circuit for the next 2 years. 
 

While an Assistant State Attorney in Orlando, Ralph managed a Felony caseload consisting of 100’s of simultaneously active matters. He served as the lead prosecutor for the State of Florida on a diverse array of serious criminal cases, prosecuting charges for Drug Trafficking, Crimes of Violence including Robbery, Aggravated Battery, and Aggravated Assault, Sex Crimes, Firearms and Weapons Offenses, DUI with Serious Bodily Injury, Home Burglary, Aggravated Fleeing & Eluding, Fraud, and Hate Crimes, among many other offenses.

As an ASA in Orlando Ralph tried numerous major felony cases to a Jury Verdict and served as lead counsel for the State in the vast majority. He brought home several big-wins, and achieved convictions at trial for Fentanyl Trafficking, Aggravated Assault, Firearms Crimes, and DUIs, among others. Ralph prides himself on his analytical mind, legal arguments, interpersonal, and problem-solving skills, many of which he honed through his extensive experience arguing and winning pretrial motions including Motions to Suppress Evidence and Motions to Dismiss. 

In one instance, Ralph was able to save from suppression two (2) separate full confessions given by a Defendant in an Armed Fentanyl Trafficking case that involved an overdose Death by identifying and arguing the nuances of when/where the 5th amendment applies to a person’s statements. In under 2 years Ralph closed a whopping 493 active Felony Cases in Orlando alone, boasting an overall conviction rate of more than 92.5%. In managing these cases Ralph worked tirelessly to both achieve the best results possible for individual circumstances, vowing to never quit on a case that could still be won, and to never let one get away. In this he made great strides in advancing the cause of criminal justice reform in the State of Florida.

Ralph has always strived to stand beside “most vulnerable person” in any given situation, which eventually led him to leave prosecution to go full-time into to private practice as a Criminal Defense Attorney. His blue-collar, no-quit attitude, devotion to his clients, and willingness to roll up his sleeves to find creative ways to win in even the toughest of cases has led him to landmark success, and to share some incredible victories with the people entrusted to his care. Ralph specializes in defending all crimes brought in the Florida State Court System but possesses a wealth of experience, and a keen interest, particularly in the defense of Drug Trafficking and Murder charges.

In an especially complex, and deeply emotional case for a client accused of Murdering his Wife, Ralph gathered and utilized the support and expertise of top medical doctors to craft an unforgettable defense, which centered around his client’s devotion to his family and his mental health during the commission of the Murder. Ralph presented the Court at sentencing with a comprehensive psychiatric profile of his client which clearly illustrated diminished mental capacity & battles with major depressive disorder. At the conclusion of the case, Ralph and his client ultimately walked out of the Courthouse arm-in-arm that very same day—Ralph’s strategy worked, successfully winning not only his client’s freedom, but a second chance. Despite being charged with Spousal Murder, Ralph’s client received a sentence of straight probation and no additional jail time.

Ralph has studied the State’s strategy, strengths, and weaknesses, and identities the best way to attack a case, never letting up until the fight is won. Ralph is always eager to partner with new clients in the defense of their rights against the those in power who seek to bully them away. He has never met a problem he did not believe he could fix and brings to his practice at O’Mara Law Group the fundamental belief that every person is worthy of respect and dignity and deserves someone willing fight for them. From the moment he took the Oath of Attorney, Ralph vowed that he would never shy away from this fight to ensure that the “little guy” is treated just the same as anybody else.
